In a proactive move to shield minors from the perils of online predators and harmful content, Florida Governor Ron DeSantis signed HB3 into law on March 25, 2024. This groundbreaking legislation prohibits children under the age of 14 from creating their own social media accounts, marking a significant stride in safeguarding the well-being of Florida’s youth in the digital age.
The exponential rise in social media usage, propelled by the ubiquity of smartphones, has reshaped the landscape of human interaction. Platforms such as Facebook, Twitter, Snapchat, and TikTok boast a staggering combined user base of approximately 5 billion individuals worldwide in 2024.
However, the allure of prolonged engagement for advertising revenue, often at the expense of user well-being, has been starkly illustrated by internal revelations from companies like Facebook.
Alarmingly, the surge in social media usage has paralleled an uptick in youth depression, cyberbullying, and online exploitation. The U.S. Surgeon General has issued a stark warning, citing that children and adolescents spending more than three hours daily on social media face a doubled risk of experiencing symptoms of depression and anxiety. The addictive nature of social media exacerbates these concerns, particularly for younger children who may struggle to break free from harmful online habits.
The Florida legislation specifically targets individuals under 14 years old, prohibiting them from assuming ownership of social media accounts. Furthermore, it empowers parents to make informed decisions regarding the online presence of children aged 14 to 15. Additionally, the law mandates stringent age verification measures for explicit websites and safeguards the online anonymity of Florida residents, enhancing digital privacy protections.
